Rental Terms & Conditions
Everything explained in plain & simple language
A customer placing an order on SharePal's website (www.sharepal.in) or through an online order form agrees to abide by the following terms and conditions.
1. Rental contract
By renting a product the customer enters into a rental contract with SharePal, wherein SharePal transfers the rights to use the product to the customer on payment of the rent to SharePal and thus the customer is the deemed owner of the usage rights of the good. In no way this contract signifies that the good(s) belong to you on a permanent basis and the same has to be returned back to SharePal in the original condition in which it was delivered to you
2. Tenure of the contract
The tenure of the contract is equivalent to the tenure of the contract that has been chosen by the customer while placing the order. The return date is fixed and is imprinted on the proforma invoice, the product/accessory has to be returned in as-is condition, by the return date, as was delivered to the customer by SharePal.
In case you want to return the product earlier, before the end of your tenure, there will be no refund of the rental amount collected from you, whatsoever. In case you want to extend the tenure, it can be done based on the availability of the product and at the discretion of SharePal.
3. Payment Policy
The total payment of each order includes the rental amount, refundable deposit ( for some categories ) and delivery/pick-up charges if any.
The payment can be done online while placing the order or upon delivery via a payment link.
4. Delivery Policy
Your order will delivered as per your selected delivery date at your selected delivery address. The usual delivery time is between 3 pm to 8 pm. In case there are delays, our operations team will notify you
Please note that the delivery is done by a 3rd party courier partners, who will only deliver the order and not perform any other task.
SharePal does a thorough quality check before delivery. The customer is also expected to see if there are any damages and report the same to SharePal within 2 hour(s) of delivery so that an exchange may be arranged.
SharePal does not guarantee that the same item would be made available for exchange. Once the delivery is complete, no request for refunds will be entertained.
5. Pick-up Policy
The products have to be returned to SharePal on the following day of the end of the rental tenure.
Doorstep Pick-up - The rented products will be picked up by SharePal or any other 3rd party courier as assigned by SharePal on the following day after your rental end date. Location: The address provided while placing the order. Time: 10am to 1pm. Charges: Free
6. Damage Policy
In case of any damage or missing product(s), the company will inform you of the same upon receiving back the product. The customer agrees to pay for any damage to, loss of, or any theft (disappearance) of items, regardless of cause or fault.
What is considered damage?
Any permanent change in the physical appearance of the product or any change or loss of functionality of the product is considered as damage. Minor wear & tear due to the general usage of the product is not considered as damage.
Deposit Deduction
If the product rented by you qualifies to be considered as damage, the damage cost will be deducted from the security deposit paid by the customer. In case the damage or loss of the product is greater than the amount of security deposit, the customer will be responsible.
Repairable Damage
Actual Repair Cost + Rs 250 ( to cover our logistics expense )
Irreparable Damage
Pay 70-90% of the product’s current retail price depending on the age of the product. After payment of charges you keep the product with you.
Loss or Theft
Pay 70-90% of the product’s current retail price depending on the age of the product
7. Security Deposit Refund Policy
If the product quality check is complete without any reports of damage to the product, the whole amount of refundable deposit will be refunded to the customer without any interest within 3 working days of the receipt of goods.
The refund will be processed via a payout link which will be sent via email/SMS/WhatsApp, where the customer is expected to enter his/her account details. Both NEFT and UPI transfer options are available.
8. Verification Policy
All customers must complete a verification process as set by the company. Verification can be completed by the customer before or after placing the order. The order will be confirmed only once the verification is approved. This is only to ensure the safety & security of the products rented out by the company. SharePal may ask you to do the following verifications
• Identity verification using aadhar / driving dicence / passport
• Occupation verification using official email / employee ID / business card / social media handle
• PAN verification using PAN number and associated mobile number
• Address Proof using rental agreement / passport / aadhar / or a utility bill
One of the verifications ( identity or occupation ) needs to be done via OTP method to successfully verify your identity.
The customer grants "Sharepal ", permission to obtain their credit information from Credit Information Companies (such as Recordent Private Limited or the likes) for the purpose of assessing their creditworthiness and providing personalized product offerings
In case the verification is not completed by the customer or is not satisfactory, SharePal reserves the right to cancel the order. In such an event, any payment done by the customer will be refunded back to the customer within 3 working days.
9. Zero Deposit Policy
As part of our ongoing efforts to enhance accessibility, we have eliminated the need for a deposit on select items. This means you can now enjoy the convenience of renting without the initial deposit requirement.
Responsibility in Case of Damage, Loss, or Theft: Clear and Fair TermsWhile we trust that you will take great care of our rented items, we understand that unforeseen circumstances may arise. In the event of damage, loss, or theft, we have established transparent terms for your convenience:
• Repairable Damage: Actual repair cost plus a nominal Rs 250 to cover logistics expenses
• Irreparable Damage: Payment of 70-90% of the product’s current retail price, depending on its age. Once paid, you may keep the product.
• Loss or Theft: Payment of 70-90% of the product’s current retail price, depending on its age.
Invoice Transparency: To ensure clarity and transparency, SharePal will issue a separate invoice for any charges related to damage, loss, or theft. This streamlined process aims to make your experience straightforward and stress-free.
10. Extension Policy:
In case the customer is not able to return the product(s) as per the actual return date and time, the customer is liable to pay the rent and extend the return date. There are no penal charges—just the rent for the additional days.
11. Governing Law, Jurisdiction and Dispute Resolution
• The Terms and the use of the website are governed by and construed in accordance with the laws of India.
• In the event any dispute or difference arises between the User and SharePal in connection with the validity, interpretation, termination and implementation or alleged breach of any provision of the Terms (“Dispute”), both Parties hereto shall endeavor to settle such dispute within a period of 14 days, amicably with each other and in good faith.
• Upon failure to amicably settle any Dispute, the dispute shall be resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996.Notwithstanding anything to the contrary contained herein, any dispute, controversy and / or claim arising out of and / or relating to this contract, including its construction, interpretation, meaning, scope, operation, effect and / or validity thereof (“Dispute”), shall be resolved by arbitration, administered by Presolv360, an independent institution, in accordance with its Dispute Resolution Rules (“Rules”).
The parties agree that the arbitration shall be before a sole arbitrator appointed under the Rules. The juridical seat of arbitration shall be Bangalore, India. The language of the arbitration shall be English. The law governing the arbitration proceedings shall be Indian law. The decision of the arbitrator shall be final and binding on the parties. Subject to the above, the competent courts at the seat shall have exclusive jurisdiction.
The parties agree to carry out the arbitration proceedings virtually through the online dispute resolution (“ODR”) platform of Presolv360 (https://presolv360.com/) and, for such purpose, the email addresses and / or mobile numbers available, provided or otherwise referenced in the contract shall be considered. Each party shall be responsible for intimating such institution in the event of any change in its email address and / or mobile number throughout the arbitration proceedings. In the event the arbitration proceedings cannot be administered virtually in the opinion of the arbitrator, the proceedings shall be conducted physically, and the venue of the proceedings shall be as determined by the arbitrator having regard to the circumstances of the case, including the convenience of the parties.
• The courts of Bangalore, India shall have the sole and exclusive jurisdiction in respect of any matters which may be instituted before any court of law, arising from the use of the services offered by SharePal.
